In short: NOCTUX is a monthly subscription service per shop, with no minimum term. You can sign up yourself from the app and try it free for 14 days; you manage your own team. The shop’s data belongs to the shop: you can export all of it to Excel from the app at any time, and if you cancel we will help you take it with you before deleting it.

Hereinafter, “NOCTUX” or “the provider”. These terms govern the purchase and use of the NOCTUX service by customer shops and their users.

2. Purpose of the service

NOCTUX is a cloud-based management application (SaaS) for engine machine shops. Among other functions, it allows you to:

The service is provided as it is available at any given time through the web (noctuxapp.com/app) and through the iPhone, iPad and Android apps published on the App Store and Google Play. NOCTUX is an internal management tool: it does not replace the shop’s own tax, accounting or legal obligations.

3. Sign-up and user accounts

Sign-up is done from the app: the shop’s owner or manager (“the owner”) creates their account, confirms their email address and sets up the shop’s workspace. By doing so, they accept these terms.

Shops whose workspace was set up by the NOCTUX team before this version, after agreeing the terms with the person in charge of the shop, keep it under those same terms; in all other respects these terms apply to them. Exceptionally, NOCTUX may agree in writing (by email) to a sign-up of that kind with a specific shop.

4. Price and billing

5. User obligations

The shop and its users undertake to:

Serious or repeated breach of these obligations may lead to suspension or termination of the service, with prior notice where possible.

6. Data ownership

The shop’s data belongs to the shop. The jobs, customers, quotes, photos, videos and other information that the shop enters in NOCTUX are the property of the shop. NOCTUX stores and processes them solely to provide the service.

7. Availability and support

8. Cancellation of the service and what happens to the data

The shop can request cancellation at any time through the contact channels indicated, without penalty. The owner of a shop that signed up from the app can also delete their account from within the app (Settings → “Delete my account”): doing so immediately deletes the shop and all its data, and their team loses access. Deleting the account does not cancel the store subscription, which must be cancelled from the store itself. After cancellation:

9. Limitation of liability

10. Data protection

The processing of personal data (users’ account data and the data the shop enters about its own customers) is governed by the NOCTUX privacy policy, which forms part of these terms.

With regard to the data of end customers that the shop enters in the app, the shop acts as data controller and NOCTUX as data processor, processing that data solely to provide the service and in line with the safeguards described in that policy.

12. Governing law and jurisdiction

These terms are governed by Spanish law.

For any dispute arising from the service, the parties submit to the courts and tribunals that have jurisdiction under the applicable regulations. As this is a service aimed at professionals and businesses (shops), unless mandatory rules provide otherwise, the parties submit to the courts and tribunals of the provider’s place of residence.

Before going to court, the parties will try to resolve any disagreement in good faith by getting in touch through the channels indicated in these terms.

13. Version and changes

The current version of these terms is that of 15 October 2026, which makes sign-up from the app the standard route and adds the in-app support chat. The previous version, of 12 October 2026, introduced sign-up from the app, the free trial and purchase through the stores.

The provider may update these terms to adapt them to legal changes or changes to the service. Relevant changes will be notified to shops with reasonable advance notice by email or from within the app. If a shop does not agree with the new terms, it may cancel before they come into effect.

For any questions about these terms: [email protected].
